BORNEONISATION SUIT ON FULL TRIAL

FUNG FON CHEN, 70, and ex-teacher Mohd Nazib Maidan Dally, 35, as well as the defendents. The court has also given the first defendant, Federal Government to file their affidavits in opposition by Sept 18.

The Federal Government would not be allowed to file their affidavits if unable to do so by the given time.

Justice Wong had on July 23 ordered the Federal Government to file their affidavits in opposition by Aug ust 24 but the defendant had requested more time.

Counsel Nur Aimi Binti Arazmi appeared for the Federal Government told Justice Wong that the defendant is requesting one more month to file their affidavits on reason that they are still waiting for the report from the Police Commission and the Education Commission.

Counsel Ken Yong representing the plaintiffs contended that the Federal Government is delaying the hearing with such excuses.

Yong told the court that it is a delaying tactics by the Federal Government because to take such a long time to obtain the affidavits is unbelievable.

The court had on May 25 dismissed the application of the Federal and State governments to strike out the "Borneonisation" suit ruling, among others, that the plaintiffs have the right and the locus standi to come to court for the court to decide whether the government has failed to implement the undertakings and assurances contained in the Malaysia Agreement of 1963.
